WARSAW BY BIKE Rental
§1. General Provisions
- These Terms and Conditions define the rules for using the services of the bicycle and accessories rental operating under the brand WARSAW BY BIKE.
- The rental is operated by MAKAK Karol Popławski, ul. Filtrowa 83/8, 02-032 Warsaw, NIP: 526 258 09 69, REGON: 140427187, hereinafter referred to as the Lessor.
- These Terms and Conditions specify, in particular, the rules for reservations, concluding agreements, payments, security deposits, pick-up and return of equipment, Customer liability, complaints, and reservation cancellations.
- Online reservations are made via the website: https://warsawbybike.pl/.
- These Terms and Conditions are available on the Rental’s website in a format that allows for downloading, saving, and printing.
§2. Definitions
- Customer – a natural person, legal person, or an organizational unit entering into an Agreement with the Lessor.
- Consumer – a natural person entering into an Agreement for purposes not directly related to their business or professional activity.
- Sole Proprietor with Consumer Rights – a natural person entering into an Agreement directly related to their business activity, where the content of the Agreement indicates that it does not have a professional character for that person within the meaning of Art. 38a of the Consumer Rights Act.
- Equipment – bicycles (city, trekking, gravel/MTB/premium, electric), trailers, child seats, helmets, locks, and other accessories provided for rent.
- Agreement – an equipment rental agreement concluded on-site or remotely (online).
- Price List – the current list of rental prices, security deposits, and additional fees, available on the Rental’s website or attached to these Terms and Conditions.
- Electronic Service – a service provided electronically within the meaning of the Act on Providing Services by Electronic Means, including: the reservation form, contact form, and email communication related to the reservation.
§3. Reservation and Conclusion of the Agreement
- The Customer may make a reservation: a) online – via the reservation form on the website, b) via email – particularly in the case of group rentals.
- The Agreement may be concluded: a) on-site – by signing the documents at the equipment pick-up point, b) remotely (online) – by making a reservation, accepting the Terms and Conditions, and making the required payment. The Agreement is concluded upon confirmation of the reservation by the Rental.
- The Customer receives a reservation confirmation at the provided email address. Providing a correct email address is a prerequisite for making an online reservation.
- To use online reservations, the following are required: a) a device with Internet access, b) an up-to-date web browser supporting JavaScript and necessary cookies, c) an active email account.
- To conclude an Agreement online, the Customer: selects the Equipment and date, fills out the form, reviews the price summary, accepts the Terms and Conditions, and makes the payment (if required). Before placing the order, the Customer has the opportunity to verify and correct the entered data.
- Confirmation of the Agreement, along with the Terms and Conditions and Price List, is sent to the Customer on a durable medium (email) immediately after the conclusion of the Agreement.
- The Rental may refuse to process a reservation in case of lack of Equipment availability or a system error. In such cases, payments made will be refunded immediately, no later than within 14 days.
- If the delivery of the reserved Equipment model is not possible, the Rental may propose Equipment with similar parameters. If the Customer does not accept the proposal, the Rental will refund the payments made.
§4. Payments and Security Deposit
- The rental fee is determined according to the Price List and the reservation summary.
- The Rental collects a security deposit to ensure the proper performance of the Agreement. The amount of the deposit is specified in the Price List.
- The deposit is collected at the time of Equipment pick-up, in cash or via a credit card charge/pre-authorization – depending on available payment methods.
- The deposit is returned after the timely and proper return of the Equipment in a condition not deteriorated beyond normal wear and tear.
- The deposit is returned in the nominal amount, without interest.
- In the event of damage, missing items, or the need for professional cleaning of the Equipment, the Rental has the right to deduct the appropriate amount from the deposit. If the damage exceeds the value of the deposit, the Customer is obliged to pay the difference.
§5. Pick-up and Return of Equipment
- The standard pick-up location is at ul. Stawki 19, 01-040 Warsaw, unless otherwise agreed by the parties.
- Upon pick-up, the Customer is required to present a valid ID (ID card or passport).
- Equipment is issued in good technical condition. The Customer is obliged to inspect the Equipment upon pick-up and report any comments before starting the rental.
- Equipment should be returned within the time and at the location specified in the Agreement, complete and in an undeteriorated condition.
- Returning the equipment after the deadline may result in an additional fee according to the Price List.
- Responsibility for the Equipment passes to the Customer upon its release and continues until its return and acceptance by the Rental.
§6. Rules of Use and Customer Obligations
- The Customer agrees to use the Equipment in accordance with its intended purpose, with due diligence, and in compliance with applicable laws.
- The following are prohibited: a) providing the Equipment to third parties without the Rental’s consent, b) making alterations or repairs without the Rental’s consent, c) using the Equipment in competitions, races, or in a manner that causes excessive strain, d) using the Equipment under the influence of alcohol or intoxicants, e) taking the Equipment outside the borders of Poland without prior consent from the Rental.
- The Customer is obliged to properly secure the Equipment against theft and not to leave it unattended.
- The maximum permissible weight of the user, including luggage, is 110 kg, unless the manufacturer of the specific model indicates otherwise.
- The Customer is liable for fines and penalties imposed during the rental period.
- Children may use the Equipment only under the constant supervision of a guardian, who bears full responsibility for their safety and the proper use of child seats and trailers.
§7. Breakdowns and Damage
- In the event of a breakdown or damage to the Equipment, the Customer is obliged to immediately contact the Rental.
- Repairs are prohibited without the Rental’s consent.
- Whenever possible, the Rental will provide service support or replacement Equipment.
- The costs of repairs resulting from the Customer’s fault shall be borne by the Customer based on the cost of parts and labor.
§8. Theft or Loss of Equipment
- In the event of theft or loss of Equipment, the Customer is obliged to immediately report the incident to the Police and inform the Rental.
- The Customer bears financial liability for the loss of Equipment unless it occurred for reasons for which the Customer is not responsible.
- The Rental has the right to retain the security deposit and seek compensation only to the extent that the Customer is liable for the loss of the Equipment.
§9. Withdrawal from the Agreement and Reservation Cancellation
- As a rule, a Consumer has the right to withdraw from a distance agreement within 14 days.
- However, the right of withdrawal does not apply to Agreements for the provision of services related to leisure or recreation if the Agreement specifies the day or period of service provision (Art. 38, point 12 of the Consumer Rights Act).
- For reservations made for a specific day or period, the Customer acknowledges the lack of the right to withdraw based on paragraph 2.
- Reservation Cancellation: a) up to 14 days before the planned pick-up (until 9:00 AM) – refund of the rental fee, b) later than 14 days before the planned pick-up – the rental fee is non-refundable.
- Cancellations must be reported via email to: info@sklepzrowerami.pl.
- Refunds will be processed within 14 days.
§10. Complaints
- Complaints should be submitted via email to info@sklepzrowerami.pl or in writing to the Lessor’s registered office.
- The complaint should include the Customer’s details, reservation number, description of the event, and the request.
- The Rental will provide a response within 14 days of receiving the complaint.
- Consumers may use out-of-court methods for resolving complaints and pursuing claims, particularly by contacting the local municipal/county consumer ombudsman or the Trade Inspection.
§11. Liability for Safety, Health, and Accidents
- Use of the Equipment is at the Customer’s own risk.
- The Rental is not liable for damages arising from the use of the Equipment, unless they result from the Rental’s willful misconduct or negligence; this does not limit the Rental’s liability for damages caused by its fault, particularly if technically faulty Equipment was issued.
- The Rental is not liable for damages resulting from circumstances on the Customer’s side, in particular: a) failure to comply with traffic regulations, b) the Customer’s lack of skill or experience, c) failure to adjust speed to conditions, d) using the Equipment in a manner inconsistent with the Terms and Conditions, e) weather conditions or surface conditions.
- The Customer declares that their state of health allows for the use of the Equipment and that there are no medical contraindications for cycling.
- The Customer bears full responsibility for the safety of children using the Equipment, particularly regarding their transport in seats or trailers and the proper securing and supervision of children.
- The Rental is not liable for damage to the Customer’s property, including the loss or damage of personal items (e.g., phones, cameras, luggage) occurring while using the Equipment.
- The Rental carries civil liability insurance for its business activities covering damages caused by the Rental’s fault, in accordance with applicable laws.
§12. Force Majeure
- The Rental is not liable for non-performance or improper performance of the Agreement caused by force majeure, including but not limited to weather conditions, government decisions, street closures, or random events.
- As a rule, weather conditions do not constitute grounds for free reservation cancellation.
§13. Personal Data
- Customer personal data is processed in accordance with the GDPR for the purpose of executing the Agreement.
- Detailed information is provided in the Privacy Policy available on the Rental’s website.
§14. Final Provisions
- In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and the Consumer Rights Act shall apply.
- The Rental reserves the right to change these Terms and Conditions. Changes apply to Agreements concluded after their publication.
- These Terms and Conditions are effective as of February 1, 2026.

Appendix No. 1
PRICE LIST FOR RENTALS, SECURITY DEPOSITS, AND ADDITIONAL FEES WARSAW BY BIKE
1. Bicycle Rental Prices
- City Bike – 50 PLN / day
- Premium City Bike – 80 PLN / day
- Trekking Bike – 60 PLN / day
- Gravel / MTB Bike – according to the current offer (from 120 PLN / day)
- Electric Bike (E-Bike) – according to the current offer (from 120 PLN / day)
A rental day is counted as one calendar day unless the Agreement states otherwise.
2. Accessories (Optional)
- Helmet – 10 PLN / day
- Lock – included in the rental price
- Phone holder – 9 PLN / day
- 20L bike pannier – 15 PLN / day
- Child helmet – included in the rental price
- Child Seat – 30 PLN / day
- Child Trailer (1 child) – 100 PLN / day
- Child Trailer (2 children) – 100 PLN / day
- Cargo / Utility Trailer – according to the current offer (from 200 PLN / day)
3. Security Deposit
- The deposit is collected at the time of equipment pickup and is refunded upon its timely and proper return.
- The deposit may be withheld until the circumstances of any incident are clarified; if the Customer is found not responsible, the deposit shall be refunded.
- Deposit amounts for individual equipment items:
- City / Trekking Bike – 300 PLN
- Premium City Bike – 400 PLN
- Gravel / MTB Bike – 800 PLN
- Electric Bike – 1,000 PLN
- Trailers / Seats – 400 PLN
4. The Rental reserves the right to collect a higher deposit for group or special rentals.
4. Late Return Fees
- Over 1 hour delay – a fee for an additional rental day will be charged.
5. Cleaning Fees
- Standard dirt (mud, dust) – no charge.
- Excessive dirt requiring professional cleaning – 50–150 PLN.
6. Damage and Repairs
The Customer covers the actual cost of parts and labor for repairs resulting from their fault, including but not limited to:
- Inner tube / puncture – from 30 PLN
- Tire – from 120 PLN
- Derailleur / Brakes – according to service valuation
- Frame / component damage – according to service valuation
- Repairs are carried out by the Rental or an authorized service provider.
7. Theft or Loss of Equipment
In the event of theft or loss of Equipment:
- The security deposit is non-refundable.
- The Customer is obliged to cover the difference up to the full market value of the Equipment if the deposit does not cover it.
8. Delivery and Collection (Optional)
- Delivery / Collection within Warsaw – 99 PLN (one way).
- Delivery outside Warsaw – individual quote.
9. Cancellation
According to §9 of the Terms and Conditions:
- Cancellation up to 14 days before pick-up – rental fee refund.
- Later cancellation – no rental fee refund.
10. Final Provisions
This Price List is an integral part of the WARSAW BY BIKE Rental Terms and Conditions.
All prices are in Polish Złoty (PLN) and include VAT where applicable.
